Workers’ compensation is a form of insurance that provides financial benefits to employees who are injured on the job. Except for Texas, all states require most employers to carry workers’ compensation insurance (Texas does not require private employers to purchase workers’ compensation).

The process for filing a workers’ compensation claim differs by state. However, if you’re injured on the job and choose to file a workers’ compensation claim, you’ll almost certainly interact with your state’s workers’ compensation agency (sometimes called a “workers’ compensation board,” “workers’ compensation commission,” or “workers’ compensation department”).

What is a state workers’ compensation agency?

Every state has passed laws creating agencies to handle workers’ compensation matters within the state. The amount of authority these agencies have and the specific role they play with respect to workers’ compensation claims varies.

In most states, the workers’ compensation agency will hear and make decisions on workers’ compensation claims that are appealed.

For example, if your insurance company denies your work injury claim in Indiana, you can file an appeal (called an “Application for Adjustment”) with the Indiana Workers’ Compensation Board. The Board will listen to the respective arguments and issue a decision.

In addition to handling appeals and other claim disputes, workers’ compensation agencies may:

  • Adopt rules to carry into effect the state’s worker’s compensation law
  • Review claims when filed
  • Modify or change claim awards
  • Approve settlements between workers and insurers
  • Conduct investigations
  • Certify that employers are in compliance with state workers’ compensation laws
  • Handle questions from employers and employees

Workers’ compensation agencies are also a terrific resource for forms, compliance information (most workers’ compensation agency websites provide a tool to search for your employer and find out whether they carry active workers’ compensation insurance), frequently asked questions, reports and publications, and employee safety resources.
