A “toxic tort” is a special kind of personal injury case that involves a plaintiff who is injured or becomes seriously ill due to exposure to a toxic substance at work, at home, in pharmaceuticals or in the general environment. Toxic torts often fall under premises liability law; however, these cases are particularly challenging to litigate since the plaintiff must demonstrate that their injury happened as a result of the toxic substance and not some other factor (causation). Testimony from expert witnesses is often necessary to establish causation in toxic tort cases. Some toxic torts become class action lawsuits when a large number of people are affected.
